COSMOPlat Industrial Internet Platform User Service Agreement

1.This User Agreement will be used to define, adjust and manage the legal relationship between COSMOPlat Platform as service provider and User as service user in the use of COSMOPlat Services. During your registration as a COSMOPlat user, if you do not agree to the terms of this Agreement or any of the provisions therein, you shall immediately discontinue the registration process. By registering or using COSMOPlat services, you acknowledge and agree to be bound by the terms of this Agreement.

2.When you use a particular service of COSMOPlat Services, there may be other terms or policies related to that service. These terms or policies shall be deemed to supplement and be an integral part of this Agreement. In case of any discrepancy between this Agreement and relevant terms or policies, relevant terms or policies shall prevail to the extent of such discrepancy.

3.When you enjoy the services of a third party partner or service provider through COSMOPlat, you shall abide by the terms and conditions of use of relevant third parties in addition to this Agreement.

4.We may amend this Agreement from time to time at our discretion to the extent permitted by applicable laws and regulations. If any amendment to this Agreement materially affects your rights or obligations, we will notify you in advance by reasonable means. If you continue to use COSMOPlat's services after this Amendment becomes effective, you represent that you have read, understood and unconditionally agreed to such changes.

1.COSMOPlat platform aims to allow users to conveniently enjoy all COSMOPlat services through one account. Therefore, for the purpose of using this service, you can either open a new COSMOPlat account or use your registered account on other sub-platforms of Haier COSMOPlat Industrial Internet Platform.

2.You should always pay attention to the security of your COSMOPlat account (e.g. avoid using too simple user password, and avoid sharing account with third party). We are not responsible for any loss caused by unauthorized use of your account. If you find any unauthorized account usage or other account security issues (such as password theft), you should immediately contact us through [4001357277]. COSMOPlat reserves the right to terminate your account if (or COSMOPlat has reasonable grounds to suspect) any unauthorized use of your COSMOPlat account or COSMOPlat services has occurred.

3.You fully understand and agree that you are responsible for all actions under your account. For the avoidance of doubt COSMOPlat is not responsible for any damage or loss arising out of your account.

4.COSMOPlat reserves the right to freeze or terminate your COSMOPlat account if you breach this Agreement or engage in illegal activities. You shall be liable for any and all losses arising therefrom (including those suffered by COSMOPlat as a result).

5.Normally, your COSMOPlat account is your sole identification for all activities on COSMOPlat website, and each COSMOPlat account may independently conduct activities on the website unless otherwise agreed. However, Under the following circumstances, COSMOPlat shall, at its own discretion, uniformly dispose of multiple COSMOPlat accounts owned by the same and/or associated legal subjects. For example, COSMOPlat determines that different COSMOPlat accounts are actually the same user based on their associated information in registration, login and use. Associated information is, for example, one certificate, one device, and one address.

1.COSMOPlat service is applicable to natural persons, legal persons or other organizations with full capacity for civil rights and full capacity for civil conduct who have reached the age of 18. If you are under the age of 18, you must obtain permission from your parents or legal guardians to use or access COSMOPlat services. By agreeing to this Agreement, you warrant to us that you are over 18 years of age or, if you are under 18 years of age, that you have obtained permission from your parents or legal guardian to use the Services;

3.You are not allowed to:

COSMOPlat reserves the right to terminate all or part of your COSMOPlat account functions if you engage in any of the above activities or if we have reasonable grounds to suspect that you do so.

4.For the purpose of improving COSMOPlat services, COSMOPlat may update COSMOPlat from time to time (including but not limited to bug fixes, version upgrades). (The platform is not responsible for any loss caused after updating the notice).

1.You can use the related services provided by COSMOPlat. You may not use COSMOPlat Services for any purpose that is illegal or prohibited by this Agreement.

2.You agree that, as part of the Services, COSMOPlat may send you promotional materials related to COSMOPlat and its partners' products and services for promotional purposes. If you no longer wish to receive certain types of E-mail or other promotional materials, you can follow the prompts to unsubscribe.

3.Specific features or services of the Market Services provided by COSMOPlat are linked to, or provided by, third Party products and/or their related services. By using such partner services, you hereby license COSMOPlat to receive specific information about you from the corresponding partner service provider, if applicable. Your use of any partner's services is subject to the terms and conditions of use specified by the respective partner. For the avoidance of doubt, COSMOPlat makes no warranty of any kind, express or implied, for any features or services provided by third parties, and COSMOPlat disclaims and hereby releases from any liability relating to or arising out of any Partner services, including, but not limited to, functional failures or other losses caused to you. The Partner shall be fully responsible for any errors, defects or inaccuracies relating to the Partner services or for any problems in COSMOPlat Services resulting from the actions or omissions of the Partner.

4.If you obtain any products or services from a third party through the use of COSMOPlat Website, for example, service providers on COSMOPlat App Market provide services to you on the basis of the App Market, service providers will be responsible for the services provided by them to you, and COSMOPlat shall not assume any responsibility for such third party services. You understand and agree that you shall be liable for any third party claims arising out of your use of the Services, breach of the terms of this Agreement or any action taken under your account. If COSMOPlat and its affiliates, employees, customers and partners are claimed by third parties as a result of this, you shall be responsible for the settlement and indemnify COSMOPlat and its affiliates for all losses and liabilities incurred thereby. COSMOPlat shall not be liable to the extent permitted by applicable law for any indirect, punitive, special or consequential damages in connection with or arising out of the terms of this Agreement.

5.COSMOPlat will use commercially reasonable efforts to continue to provide you with high quality services. However, COSMOPlat hereby reminds you that we make no warranties of any kind, express or implied, for the COSMOPlat Services. You fully understand and agree that your use of the Service is at your own risk, for example:

6.If you fail to comply with this Agreement or any other terms or policies applicable to COSMOPlat account, COSMOPlat may, without prior notice to you:

7.You may at any time elect to deactivate some or all of COSMOPlat's services or complete your account logout, but as a result, you will not be able to use certain COSMOPlat functions. If you choose to voluntarily log out of your account, we will erase your historical data without recovery.

COSMOPlat determines attribution based on the context in which it uses user-created content. If you have specific requirements about whether and how to be credited, please let us know in writing when you provide your user-created content.

2.You are fully responsible for the User-created content you provide and for any consequences arising out of or in connection with such user-created content (including any damages COSMOPlat may suffer as a result). You hereby promise:

COSMOPlat reserves the right to delete or refuse to publish any user-created content or to freeze or terminate your account in the event of any breach of this Commitment. You agree to indemnify COSMOPlat for any losses incurred by you as a result of your breach of the above warranties and indemnify COSMOPlat against any related claims from third parties.

3.COSMOPlat is not responsible for user-created content. The views expressed in any user-created content do not represent COSMOPlat's views or values. The COSMOPlat Service serves only as a channel for the distribution of such user-created content and does not endorse any user-created content or assume any related obligation or liability for the activities of any and all users of the COSMOPlat Service or any user-created content. Under no circumstances should you trust user-created content that borrows money, asks for passwords, or otherwise involves property.

1.We respect intellectual property rights and COSMOPlat will not use, modify, copy, publicly disseminate, alter, distribute, distribute or publicly publish the results of your intellectual property rights without your consent.

5.You shall respect the intellectual property rights and other legal rights/interests of COSMOPlat and third parties. COSMOPlat reserves the right to terminate the services provided to you without refund of any money if you infringe the legal rights and interests of COSMOPlat or other partners.

1.In addition to the registration information you provide in relation to yourself when creating your COSMOPlat account, we may ask you to provide other information that is required solely for the purpose of providing services to you. You agree and undertake to provide accurate, current and complete information.

2.COSMOPlat attaches great importance to the protection of users' personal information and privacy. COSMOPlat may collect and use the personal information (including but not limited to registration information) required by you to use the service only with your consent (for example, when you register COSMOPlat account). Before using the service, please be sure to read the relevant privacy policy of COSMOPlat service carefully. Please refer to COSMOPlat Privacy Policy and its supplementary terms, tips and notices issued from time to time for details. COSMOPlat Privacy Policy is an integral part of this Agreement. For personal information and privacy protection matters, if there is any conflict between this Agreement and COSMOPlat Privacy Policy, COSMOPlat Privacy Policy shall prevail.

We shall not be liable for any delay or failure to perform our obligations under this Agreement due to force majeure (force majeure in this paragraph refers to unforeseeable, unavoidable and insurmountable objective circumstances, including changes in policies of government authorities and other institutional factors). Haier may suspend the performance of its obligations hereunder within the scope and duration of force majeure until the effect of the force majeure disappears. We will use reasonable efforts to find a solution to meet our obligations under the Agreement in the event of force majeure.

1.If any provision of this Agreement is held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not be affected or weakened in any way.

2.Without COSMOPlat's prior written consent, you may not transfer the terms of this Agreement that belong to you personally.

3.Any disputes or disputes between you and COSMOPlat shall be settled through friendly negotiation; If no agreement can be reached through negotiation, you agree to submit the dispute or dispute to Laoshan District People's Court of Qingdao for jurisdiction.
